The James Dyson Foundation is the controller of your personal information and is responsible for your personal information. All references in this policy to "James Dyson Foundation," "our," "us," or "we" refer to the James Dyson Foundation. All references in this policy to "our website" refer to the websites owned by the James Dyson Foundation at www.jamesdysonfoundation.co.uk and www.jamesdysonaward.org.

If you do not provide this information, or if you ask us to delete it, you may no longer be eligible to apply for the James Dyson Award or a bursary.

We, or third parties acting on our behalf, may collect and use any of the following information about you:

2.4 Students at schools collaborating with us

(a) What personal information we collect about you

We run programs in partnership with certain schools to develop new design and technology curricula and teaching methods. As part of these programs, we may collect the following personal information about you as a participating student:

  • (i) Your name
  • (ii) Your photo
  • (iii) Your address
  • (iv) Your responses to our interview questions. Please note that we may film your interviews if we have your consent (if you are over 16) or your parent’s consent (if you are under 16)
  • (v) Responses to any surveys we may conduct

(b) How we use your personal information

We will collect, use, and store the personal information listed above (with your or your parent’s consent) to evaluate the success of the program. We may share this information with other schools and government bodies to discuss the program’s outcomes. We may also use your photos or videos on our website, CRM system, social media channels, and printed materials.

2.5 Teachers at schools collaborating with us

2.9 Attendees at James Dyson Foundation events

(a) What personal information we collect about you

If you attend an event organized by us or on our behalf, we may collect and use any of the following information about you:

  • (i) Your name
  • (ii) Your mailing address
  • (iii) Your email address
  • (iv) Your phone number
  • (v) Your car registration
  • (vi) Your photo
  • (vii) The school or institution you attend or work at (if applicable)
  • (viii) Information provided when corresponding with us
  • (ix) Any updates to information you’ve provided
  • (x) Information you provide to help us improve our services, such as responses to surveys or questionnaires

(b) How we use your personal information

We collect, use, and store the personal information listed above for the following purposes:

  • (i) To complete any non-disclosure agreements and manage your access to the event (e.g., parking and security passes)
  • (ii) To organize the event
  • (iii) To respond to your inquiries
  • (iv) With your consent (or your parent’s consent if you are under 16), to use your image in our marketing and promotional materials
  • (v) To send you communications (by email or mail) about our services, including administrative messages (e.g., updates to our terms and conditions or your applications)
  • (vi) To conduct statistical analysis and market research on individuals interested in our awards and bursaries
  • (vii) To assess interest in design and technology and evaluate the success of our methodology, including (with your consent) your recorded responses
  • (viii) To contact you (by phone or mail) with information about our services that you’ve requested or that we believe may interest you

2.10 Additional uses of your personal information

Regardless of our relationship with you, we may also collect, use, and store your personal information for the following additional purposes:

  • (a) To respond to inquiries or concerns about how we collect, store, and use your personal information, or to fulfill requests for a copy of the information we hold about you. If we do not have a contract with you, we believe it is in our legitimate interests to process your information for these purposes
  • (b) For internal reporting, business administration, insurance coverage, facility security, research and development, and identifying and implementing organizational efficiencies. We may process your information for these purposes where it is in our legitimate interests
  • (c) To comply with applicable laws, regulations, and procedures—this may include situations where we believe it is in our or others’ legitimate interests to comply, as well as where we are legally required to do so
  • (d) To establish, exercise, or defend our legal rights—this may include situations where we believe it is in our or others’ legitimate interests, as well as where we are legally required to do so

 

2.11 Further processing

3.1 Legal bases for using your personal information

We consider the legal bases for using your personal information, as outlined in this privacy policy, to be the following:

  • (a) Our use of your personal information is necessary to fulfill our obligations under any contract with you (for example, to assess your application for the James Dyson Award or a bursary, or to comply with the terms of use of our website, which you accept by browsing it).
  • (b) Our use of your personal information is necessary to comply with our legal obligations (for example, for health and safety purposes).
  • (c) You (or your parent, if you are under 16) have given consent for us to use your personal information—for example, if you have consented to being recorded on video.
  • (d) Where none of the above apply, our use of your personal information is necessary for our legitimate interests or the legitimate interests of others (for example, to ensure the security of our website). Our legitimate interests include:
    • (i) Operating, growing, and developing the James Dyson Foundation, including providing the awards, programs, and opportunities it offers
    • (ii) Running our website
    • (iii) Promoting our activities (such as sending newsletters and other communications we believe may interest you)
    • (iv) Managing internal administrative functions

3.2 Consent-based processing

We may process your personal information based on your consent—for example, when we take your photo or record an interview with you. You may withdraw your consent at any time, as described below.

3.3 Withdrawing your consent

If we rely on your consent to use your personal information in a specific way (such as using your image in marketing materials), but you later change your mind, you can withdraw your consent by contacting us at info@jamesdysonfoundation.com, and we will stop using your information for that purpose. However, please note that withdrawing your consent may affect our ability to provide certain services to you.

4.1 Sharing with Dyson and Weybourne group companies

We may share your personal information with Dyson and Weybourne group companies when it is in our legitimate interests to do so for internal administrative purposes (for example, corporate strategy, compliance, auditing and monitoring, research and development, and quality assurance).

4.2 Sharing with third parties

We will share your personal information with the following third parties or categories of third parties:

  • (a) When you apply for the James Dyson Award, we will share your application and personal information with our moderators who help assess applications. We have moderators in each country where the award is offered, and they assess applications from their respective countries. Some moderators in the US and UK may access applications globally. Most moderators work for Dyson Group companies and may only use your personal information to help assess James Dyson Award applications.
  • (b) Related companies that provide services to us—for example, Dyson Group companies provide IT support, and Weybourne companies provide IT, finance, and accounting support.
  • (c) Other service providers and subcontractors, including payment processors, utility providers, technical and support service suppliers, insurers, logistics providers, and cloud service providers (such as AWS).
  • (d) Public agencies.
  • (e) Companies that assist with our marketing, advertising, and promotional activities, such as MailChimp (marketing automation) and photographers conducting photo shoots on our behalf.
  • (f) Analytics and search engine providers that help us improve and optimize our website, such as Google Analytics, Google Ads Tracking, and Facebook Pixels.
  • (g) If you are a student or teacher participating in a case study, we may share your interview responses with other schools and/or government bodies to demonstrate the success of our program.

4.3 Safeguards for third-party sharing

Any third parties with whom we share your personal information are legally and contractually limited in how they can use it. They may only use your information to provide services to us. We take steps to ensure that all third parties are subject to privacy and security obligations consistent with this privacy policy and applicable laws.

4.4 Other disclosures

We may also disclose your personal information to third parties:

  • (a) If substantially all of our assets are acquired by a third party, in which case personal information we hold will be one of the transferred assets
  • (b) If we are required to disclose or share your personal information to comply with a legal obligation, lawful request from government or law enforcement, or national security requirements, or to prevent illegal activity
  • (c) To enforce or apply our terms of use, terms and conditions, or other agreements; to respond to claims; to protect our rights or the rights of others; to ensure the safety of any person; or to prevent illegal activity
  • (d) To protect the rights, property, or safety of the James Dyson Foundation, our staff, moderators, or others. This may include sharing information with other organizations for fraud prevention or credit risk reduction

4.5 Anonymized and aggregated data

We may also disclose and use anonymized, aggregated reports and statistics about users of our website or services for internal reporting, reporting to Weybourne Group companies or other third parties, and for marketing and promotional purposes. These reports will not identify any individual.

4.6 No unauthorized sharing

Except as explicitly described above, we will never share, sell, or rent your personal information to any third party without notifying you and, where necessary, obtaining your consent. If you have previously given consent and later change your mind, you can contact us and we will stop using your information in that way.

We retain your personal information only for as long as necessary for the purposes for which it was collected and processed. The length of time we keep your information depends on the specific purposes for which we collected and use it, and/or as required to comply with applicable laws and to establish, exercise, or defend our legal rights.

6.1 Your rights regarding your personal information

You have certain rights in relation to your personal information. If you would like more information about these rights or wish to exercise any of them, please contact us at info@jamesdysonfoundation.com at any time. Your rights include:

  • (a) Right of access: You have the right to access any personal information we hold about you. You can request a copy of your personal information, confirmation of whether we are using it, details about how and why it is being used, and information about any safeguards in place if your data is transferred outside the United Kingdom or the European Economic Area (EEA).
  • (b) Right to update your information: You have the right to request that we update any of your personal information that is outdated or incorrect.
  • (c) Right to delete your information: You have the right to ask us to delete your personal information in certain specific circumstances. You can request more details about these circumstances by contacting us using the information in Section 12.
    We will forward your request to any third parties who have received your personal information unless doing so is impossible or requires disproportionate effort. You may ask us who those recipients are.
  • (d) Right to restrict use of your information: You have the right to ask us to restrict how we process your personal information in certain specific circumstances. You can request more details about these circumstances by contacting us using the information in Section 12.
    As with deletion requests, we will notify other recipients unless it is impossible or requires disproportionate effort. You may ask us who those recipients are.
  • (e) Right to stop marketing: You have the right to ask us to stop using your personal information for direct marketing purposes. If you exercise this right, we will stop using your information for that purpose.
  • (f) Right to data portability: You have the right to ask us to provide your personal information to a third-party service provider.
    This right only applies where we use your personal information based on your consent or a contract, and where the processing is carried out by automated means.
  • (g) Right to object: You have the right to object to our use of your personal information where we process it based on our or another party’s legitimate interests.

6.2 How we handle your requests

We will consider all such requests and respond within a reasonable timeframe (and in any case, within one month of your request unless we inform you that a longer period is permitted under applicable law). Please note that some personal information may be exempt from these requests in certain situations—for example, if we need to retain it to comply with legal obligations or to establish, exercise, or defend legal claims.

7.2    We may send you certain marketing communications (including electronic marketing communications) if it is in our legitimate interests to do so for marketing and business development purposes.

8.1 Where your information may be processed

Your personal information may be used, stored, and/or accessed by staff located outside the European Economic Area (EEA)—including, in particular, the United States and Japan—who work for us, other Dyson group companies, or suppliers and moderators for the James Dyson Award. 8.2 How we protect your information when transferred internationally

If we transfer your personal information to any non-EEA members of our group or to suppliers, we will take appropriate steps to ensure that your information is protected in line with this privacy policy. These steps may include safeguards permitted under Articles 45 and 46 of the General Data Protection Regulation (GDPR), such as:

  • (a) For US-based entities: entering into European Commission-approved Standard Contractual Clauses or ensuring participation in the EU-U.S. Privacy Shield Framework (see https://www.privacyshield.gov/welcome)
  • (b) For entities in other countries outside the EEA: entering into European Commission-approved Standard Contractual Clauses

9.1 The main risk of our processing of your personal information is if it is lost, stolen or misused. This could lead to your personal information being in the hands of someone else who may use it fraudulently or make public, information that you would prefer to keep private.

9.2 For this reason, James Dyson Foundation is committed to protecting your personal information from loss, theft and misuse. We take all reasonable precautions to safeguard the confidentiality of your personal information, including through use of appropriate organisational and technical measures such as controlled access to our premises, staff training, passwords for systems access, firewalls, encryption, web filtering and anti-virus software.

9.3 In the course of provision of your personal information to us, your personal information may be transferred over the internet. Although we make every effort to protect the personal information which you provide to us, the transmission of information over the internet is not completely secure. As such, you acknowledge and accept that we cannot guarantee the security of your personal information transmitted to our website and that any such transmission is at your own risk. Once we have received your personal information, we will use strict procedures and security features to prevent unauthorized access to it.

9.4 Where we have given you (or where you have chosen) a password which enables you to access your online account, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Our website may contain hyperlinks to websites that are not operated by us. These hyperlinks are provided for your reference and convenience only and do not imply any endorsement of the activities of such third-party websites or any association with their operators.
