Using the Website

  1. This website is owned and operated by The James Dyson Foundation of Tetbury Hill, Malmesbury, Wiltshire, SN16 0RP (registered charity number 1099709). Orders and downloads from this website are orders and downloads from us.
  2. By using this website and ordering goods from it, you agree to these terms and conditions (the “Conditions”), and you accept that the Conditions and your use of the website shall be governed by English law and are subject to the exclusive jurisdiction of the English courts. Nothing in these Conditions affects your statutory consumer rights.
  3. Please ensure that any information you provide to us is accurate and current.
  4. Remember to check the Conditions when you use the website as we may change the Conditions from time and time and you will be subject to the Conditions in force at the time that you use the website. We may change the terms and availability of goods without notice to ensure they are as up to date as possible.
  5. We try to make sure all the information on the website is accurate, but if we have made a mistake and you spot it, please let us know. Please regularly update your computer’s virus protection software as we can’t guarantee that the website will be free from viruses.
  6. We may suspend or terminate access to the website without notice.

Ordering the Education Box from the Website

  1. Even though we try to accept all requests for resources, sometimes this might not be possible. If your order is declined or postponed by us, you will be contacted and, if possible, another delivery date will be arranged.
  2. We can only accept Education Box orders from, and dispatch goods to addresses in the United Kingdom.
  3. Delivery dates of the Education Box are intended to be a guide only. We will try to deliver the Education Box as close to your requested dates as we can, subject to availability of stock.
  4. The Education Box will be at your risk from the time of delivery. However, ownership of the Education Box will not pass to you unless this has been specially agreed by the James Dyson Foundation.

Returns

  1. We will arrange for the Education Box to be collected from the agreed delivery address at our expense at the earliest convenient opportunity.
  2. You may cancel your Education Box order at any time up to 7 days after receiving the goods by notifying us in writing by either:
    1. email to education@dyson.co.uk
    2. post to the address above, marked for the attention of Education Boxes;

Liability

  1. We hope that you will be totally satisfied with the resources you access through our website. Our liability for losses you suffer as a result of us not complying with these Conditions is strictly limited to any losses which are a foreseeable consequence of us not complying with these Conditions. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.
  2. We will not be responsible for any indirect or consequential loss of any kind (including but not limited to loss of profits, revenue, or goodwill) howsoever arising in connection with your use of the website and any goods ordered from the James Dyson Foundation.
  3. We do not limit in any way our liability:
    1. for death or personal injury caused by our negligence;
    2. under section 2(3) of the Consumer Protection Act 1987;
    3. for fraud or fraudulent misrepresentation; or
    4. for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

If you do not comply with these Conditions, we will hold you responsible if we suffer any loss as a result.

Intellectual Property Rights

  1. The names, images and logos identifying the James Dyson Foundation or third parties and their products and services are subject to copyright, design rights and trade mark rights of the James Dyson Foundation and/or third parties. Nothing contained in these terms shall be construed as conferring any licence or right in respect of any copyright, design right or trade mark of the James Dyson Foundation or any third party.
  2. All intellectual property rights in all content located on this site shall remain vested in the James Dyson Foundation, unless otherwise stated. You may not reproduce, republish, download, post, broadcast or otherwise use content from this website in any way except for your own personal non-commercial use or for educational purposes. You also agree not to adapt, alter or create a derivative work from any content of this website except for your own personal, non-commercial use or for educational purposes. Use of any content from this website for publication or for commercial purposes requires the prior written permission of the James Dyson Foundation.
